FEPA was therefore given overall responsibility for environmental management and protection, ensuring that Nigeria became the first African country to establish a national institutional structure for environmental protection by the time it was established.

In 1999, the Federal Government amalgamated FEPA with other relevant Departments in other Ministries to become the Federal Ministry of Environment, but without an enabling law to address enforcement difficulties.

This caused a void in the country’s effective implementation of environmental laws, standards, and regulations.

To address the existing void, the Federal Government of Nigeria established the National Environmental Standards and Regulations Enforcement Agency (NESREA). NESREA operates as a parastatal under the Federal Ministry of Environment.

This move was made in compliance with Section 20 of the 1999 Constitution of the Federal Republic of Nigeria, which empowers the government to take necessary actions to safeguard the environment.

The Federal Environmental Protection Agency Act Cap F 10 LFN 2004 was repealed by the NESREA Formation Act 2007.

The National Assembly passed a bill establishing NESREA, which was signed into law and published in the Federal Republic of Nigeria Official Gazette No. 92, Vol. 94, on July 31, 2007.
