About NESREA

Our country, Nigeria, was poorly equipped to handle significant environmental crises before the dumping of poisonous/harmful trash in Koko village, Delta State, in 1987.

This was owing to the lack of institutional frameworks or processes for environmental protection, making it impossible to execute environmental laws and regulations in the country.

The Federal Government of Nigeria enacted the Harmful Waste Decree 42 of 1988, which led to the establishment of the Federal Environmental Protection Agency (FEPA) through Decrees 58 of 1988 and 59 (as amended) of 1992, as the country grappled with the consequences of dumping toxic waste after the incident at Koko village in Delta State.

FEPA was therefore given overall responsibility for environmental management and protection, ensuring that Nigeria became the first African country to establish a national institutional structure for environmental protection by the time it was established.

In 1999, the Federal Government amalgamated FEPA with other relevant Departments in other Ministries to become the Federal Ministry of Environment, but without an enabling law to address enforcement difficulties.

This caused a void in the country’s effective implementation of environmental laws, standards, and regulations.

To fill this gap, the Federal Government formed the National Environmental Standards and Regulations Enforcement Agency (NESREA), a parastatal of the Federal Ministry of Environment, in accordance with Section 20 of the 1999 Constitution of the Federal Republic of Nigeria.

The Federal Environmental Protection Agency Act Cap F 10 LFN 2004 was repealed by the NESREA formation Act 2007.

The National Assembly passed a bill establishing NESREA, which was signed into law and published in the Federal Republic of Nigeria Official Gazette No. 92, Vol. 94, on July 31, 2007.
